Terms of Service

These Terms of Service (“Terms”) govern your use of ThriftHaul (the “App”), a mobile application developed and operated by ThriftHaul (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

By accessing or using ThriftHaul, you confirm that you are at least 13 years of age (or the age of digital consent in your jurisdiction), that you have read and understood these Terms, and that you agree to be bound by them. If you are using the App on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Description of Service

ThriftHaul is an AI-powered mobile application that helps users identify secondhand and thrift items, estimate resale values, assess market demand, and receive platform recommendations for reselling. The App provides the following features:

• AI-powered item identification using photos taken by the user
• Estimated resale value ranges (low, average, and high) based on AI analysis of market data
• Demand scoring to indicate current buyer interest
• Platform recommendations (e.g., eBay, Poshmark, Depop, Mercari)
• A personal collection (“Treasure Chest”) to save and track found items
• Profit tracking and analytics dashboard
• Buy / Pass recommendations

3. Eligibility

You must be at least 13 years of age to use ThriftHaul. If you are under 18, you represent that you have obtained parental or guardian consent. We reserve the right to terminate accounts of users who misrepresent their age.

4. Subscriptions and Billing

4.1 Free Trial

ThriftHaul offers a free trial period of three (3) days for new users. During this period, you may access premium features without charge. After the free trial ends, continued access to premium features requires a paid subscription.

4.2 Subscription Plans

ThriftHaul offers auto-renewing subscription plans (“ThriftHaul Pro”) that unlock unlimited scans, full collection management, advanced analytics, and priority AI analysis. Subscription pricing and intervals are displayed in the App prior to purchase.

4.3 Billing and Renewal

All subscriptions are processed and managed exclusively through Apple’s App Store using Apple’s in-app purchase system. Your subscription automatically renews at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current subscription period.

4.4 Cancellation

You may cancel your subscription at any time by visiting your Apple ID subscription settings in the iOS Settings app. Cancelling stops future renewal charges; you retain access to premium features until the end of the current paid period. We do not issue refunds for unused portions of a subscription period.

4.5 Refunds

All refund requests are handled exclusively by Apple in accordance with Apple’s refund policy. We have no control over Apple’s refund decisions. To request a refund, please contact Apple Support at reportaproblem.apple.com.

4.6 Free Tier

Without an active subscription, you may be limited to a set number of scans per day. Feature access on the free tier is subject to change at our discretion.

5. User Conduct and Acceptable Use

By using ThriftHaul, you agree that you will not:

• Use the App for any unlawful purpose, including the resale of counterfeit, stolen, or prohibited goods
• Attempt to reverse engineer, decompile, or disassemble the App or its underlying AI systems
• Use automated tools (bots, scrapers, or otherwise) to interact with the App
• Transmit any malware, viruses, or harmful code through the App
• Attempt to gain unauthorised access to our systems, servers, or databases
• Harass, harm, or impersonate any person through use of the App
• Violate any applicable local, national, or international laws or regulations
• Share, resell, or redistribute access to your account or subscription

6. User Content and Photos

When you use ThriftHaul, you may submit photos and other content (“User Content”). By submitting User Content, you grant us a limited, non-exclusive, royalty-free licence to process and analyse that content solely for the purpose of providing the App’s features to you. We do not claim ownership of your photos or data.

You represent and warrant that you own or have the right to submit all User Content you provide, and that your User Content does not violate any third-party intellectual property rights or applicable laws.

Photos submitted for scanning are processed by our AI service provider and are not used to train third-party AI models without your explicit consent. Please refer to our Privacy Policy for full details on how your data is handled.

7. AI Disclaimer and Limitation of Accuracy

ThriftHaul’s AI-generated resale estimates, demand scores, condition assessments, and platform recommendations are provided for informational purposes only and do not constitute financial, legal, or professional advice.

AI-generated values are estimates based on available market data and are subject to error. Actual resale prices may vary significantly based on item condition, regional demand, platform policies, timing, and other factors beyond our control. Past resale prices do not guarantee future results.

You should independently verify any resale value before making a purchasing or selling decision. We are not responsible for any financial loss arising from reliance on ThriftHaul’s AI-generated outputs.

8. Intellectual Property

The App, including its design, code, AI models, trademarks, logos, and all content created by us, is owned by ThriftHaul and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App solely for your personal, non-commercial purposes in accordance with these Terms.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any part of the App without our prior written consent.

9. Privacy

Your use of ThriftHaul is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

10. Third-Party Services

ThriftHaul integrates with third-party services to deliver its features, including but not limited to:

• Apple App Store — for app distribution and in-app purchases
• Anthropic / AI Providers — for AI-powered item identification and analysis
• RevenueCat — for subscription management and entitlement verification

Your use of these third-party services is governed by their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

11. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF INFORMATION. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THRIFTHAUL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) USD $50.

13. Indemnification

You agree to indemnify, defend, and hold harmless ThriftHaul and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the App; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any third-party rights.

14. Apple-Specific Terms

The following terms apply to your use of ThriftHaul obtained through the Apple App Store:

• These Terms are concluded between you and ThriftHaul only, and not with Apple Inc. (“Apple”). Apple is not responsible for the App or its content.
• The licence granted to you for the App is limited to a non-transferable licence to use the App on any Apple-branded product you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
• Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App.
• In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, Apple will not be responsible for the investigation, defence, settlement, or discharge of any such claim.
• You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

15. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason including (but not limited to) violation of these Terms. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including Sections 7, 8, 11, 12, 13, and 16) shall survive.

You may stop using the App at any time. To cancel your subscription, follow the instructions in Section 4.4.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association’s rules, conducted in English.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent or remedy irreparable harm.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. For material changes, we will notify you through the App or by other means prior to the change becoming effective. Your continued use of the App after any changes constitutes acceptance of the new Terms.

18. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining Terms will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and ThriftHaul with respect to the App and supersede all prior agreements.
